1. By accessing or using Vantage Health’s services, you agree to these AI Terms on behalf of yourself, the applicable entity, or organization that you represent. 
    

2. Vantage Health AI. From time to time, Vantage may introduce features and capabilities as part of the Service that utilize artificial intelligence, machine learning, or similar technologies (the "Vantage Health AI"). These Vantage Health AI feature(s) may be developed by Vantage and/or Vantage’s third-party providers, and are a part of the Service. Vantage and its licensors exclusively own all right, title, and interest in and to Vantage Health AI, including all associated intellectual property rights. 
    

3. Input and Output.  You may provide input to be processed by Vantage Health AI (“Input”), and receive output generated and returned by Vantage Health AI based on the Input (“Output”). When you use Vantage Health AI, Input is deemed “AI Content.” The Output of Vantage Health AI are gift recommendations generated and returned by Vantage Health AI. This Output is considered part of the Vantage Health Services and owned by Vantage. You will ensure that your Input will not (i) violate any applicable law; (ii) violate these AI Terms or the Agreement; (iii) infringe, violate, or misappropriate any of our rights or the rights of any third party or (iv) contain any personal identifying information (e.g., names, phone numbers, email addresses) or proprietary information. You acknowledge that due to the nature of machine learning and the technology powering Vantage Health AI features, Output may not be unique and Vantage Health AI may generate the same or similar output to other customers. Further, the responses provided by any Vantage Health AI features are not always guaranteed to be correct or suitable for every situation. Vantage may collect and store some user data to ensure the functionality and improvement of our Vantage Health AI features. We are committed to maintaining the privacy and security of user personal information. Please refer to our Privacy for more details. 
    

4. License. You authorize Vantage and its third-party providers to process your AI Content to provide you with the Vantage Health AI feature(s). To the extent your Input contains personal data, you instruct Vantage and its third-party providers to process such personal data for the purpose of providing the Vantage Health AI feature(s) and Output. You agree that Vantage may use subprocessors to provide Vantage Health AI to you. 
    

5. Disclaimer. OUR VANTAGE HEALTH AI FEATURES ARE PROVIDED AS-IS, WITH NO WARRANTIES OF ANY KIND. WE DISCLAIM ALL LIABILITY FOR ANY DAMAGES RESULTING FROM THE USE OR INABILITY OF ANY VANTAGE HEALTH AI FEATURES, TO THE FULLEST EXTENT PERMITTED BY LAW. VANTAGE DOES NOT MAKE ANY WARRANTY REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF VANTAGE HEALTH AI OR THE ACCURACY OF ANY OTHER INFORMATION OBTAINED THROUGH Vantage Health AI. YOU UNDERSTAND AND AGREE THAT ANY MATERIAL OR DATA OBTAINED THROUGH THE USE OF VANTAGE HEALTH AI IS DONE AT YOUR SOLE RISK. NO INFORMATION OR OUTPUT OBTAINED BY YOU FROM VANTAGE OR THROUGH VANTAGE HEALTH AI SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.   
    

6. Improvement of Services. Vantage may process and use Al Content to further develop, enhance, and improve the Service and Vantage Health AI, and you consent to Vantage’s usage therefor. We do not permit our third-party providers of Vantage Health AI to use your AI Content to train their Al models without your consent. 
    

7. Usage Restrictions. You may not use Vantage Health AI or Output (a) to develop foundation models or other large-scale models that compete with Vantage or Vantage Health AI; (b) to mislead any person that Output from the Service was solely human-generated, (c) in a manner that violates any technical documentation, usage guidelines, or parameters, or (d) in a manner that infringes, violates, or misappropriate any of our rights or the rights of any third party. 
    

8. General. All other terms and conditions of the Agreement not expressly modified by these Terms shall remain in full force and effect. The Agreement, together with these Vantage Health AI Terms, set forth the final, complete, and exclusive agreement between the parties relating to the subject matter hereof, and supersedes any other agreements or communications relating thereto. 
    

9. Modifications. Vantage may, in our sole discretion, modify, or update these AI Terms from time to time (including any documentation referenced in the Agreement), so you should review such terms periodically. Your continued use of the Services and/or Vantage Health AI after any such change constitutes your acceptance of any modifications to these Terms.
